General Passenger Car Transportation Business Conditions of Carriage

                                          

(Scope of application)

Article 1 The transportation contract for the general passenger car transportation business operated by our company shall be in accordance with the provisions of this transportation agreement, and matters not stipulated in this transportation agreement shall be in accordance with laws and regulations or general customs.

2. If the Company agrees to a special contract for a part of this contract of carriage to the extent that it does not contravene the purpose of this contract of carriage and the laws and regulations, the special contract shall apply regardless of the provisions of the relevant clause.

 

(Instruction of staff)

Article 2 Passengers must follow the instructions given by our drivers and other staff to ensure transportation safety.

 

(Undertaking of transportation)

Article 3 Except for cases where the Company refuses to accept or continue transportation pursuant to the provisions of the following Article, Article 4-2, Paragraph 2, Article 4-3, Paragraph 2, or Article 4-4, Paragraph 2 , accepts the carriage of the passenger.

 

(Rejection of acceptance and continuation of transportation)

Article 4 Our company may refuse to accept or continue transportation if any of the following items apply.

(1) When the application for transportation does not comply with this transportation agreement.

(2) When there are no suitable facilities for such transportation.

(3) When the applicant requests a special burden for the transportation.

(4) When the transportation is contrary to the provisions of laws and regulations, public order or good morals.

(5) When transportation is hindered due to natural disasters or other unavoidable reasons.

(6) When the passenger does not follow the measures taken by the crew based on the provisions of the passenger car transportation business transportation regulations.

(7) When the passenger is carrying items that are prohibited from being brought in pursuant to the provisions of the Passenger Motor Transportation Business Transport Regulations.

(8) Passengers are so intoxicated that they cannot clearly tell their destination or are unable to walk without assistance.

(9) When the passenger wears unclean clothing that may contaminate the interior of the vehicle.

(10) When the passenger is seriously ill without an attendant.

(11) The passenger is a patient with a category 1 infectious disease, category 2 infectious disease, pandemic influenza or other infectious disease, or a designated infectious disease (limited to those requiring hospitalization) under the Act on Prevention of Infectious Diseases and Medical Treatment for Patients with Infectious Diseases. (Including those who are considered to be patients of these.) Or when there are findings of new infectious diseases.

 

Article 4-2 Passengers are requested to refrain from smoking in our non-smoking vehicles (vehicles marked as non-smoking vehicles; the same shall apply in the following paragraph).

2 If a passenger smokes or is about to smoke in our non-smoking vehicle, the driver may ask the passenger to stop smoking. In addition to refusal, we will ask for the fare until the passenger gets off and other charges incurred, and if smoking continues, we will stop the business and clean the vehicle, so we will compensate for the cleaning fee and the damage caused by the suspension of business. Article 4-3 Passengers acting against the provisions of laws and regulations, public order or good morals against our drivers We ask that you refrain from any act (hereinafter referred to as “harassment”) that makes our driver uncomfortable, hurts their dignity, gives them a disadvantage, or threatens them.

2 In the event of harassment, the driver will request that the harassment be stopped, and if the passenger does not comply with this request, we will refuse to accept or continue transportation, and will report to the police, etc. at the discretion of the driver or our company. .In addition, we will claim compensation for damages caused by harassment and compensation.

Article 4-4 The driver must get on or intend to ride while wearing a mask, and as a result of hearing the reason,
   When you admit that it is not, you can ask to wear a mask.
2 Persons who are required to wear a mask pursuant to the provisions of the preceding paragraph do not comply with the request and endanger the safety or health of themselves or others.
     If there is a risk of impact, we may refuse to accept or continue transportation.
3 If the Company refuses to continue transportation pursuant to the provisions of the preceding paragraph, the Company shall request the fares and charges incurred until the person in the preceding paragraph gets off the vehicle.

 (Fares and charges)
Article 5 The fares and charges received by the Company shall be subject to approval by the Director of the District Transport Bureau or notification to the Director of the District Transport Bureau at the time of passenger boarding.
      It depends on what you are doing and doing.
2 The fares and charges in the preceding paragraph are based on the amount displayed on the fare meter, except for the case of an hourly rental contract.

Article 6 We will request payment of fares and charges when passengers get off. 

 

(Responsibility for Passengers)

Article 7 We shall be responsible for compensating for the damage caused by the operation of our vehicle, if the life or body of the passenger is harmed.provided, however, that the Company and its staff did not fail to exercise caution in operating the vehicle, that the passenger concerned or a third party other than the Company's staff was intentionally or negligently involved, or that the vehicle had structural defects or functional failures. This shall not apply when it is proved that there was no such occurrence.

2. In the case of the preceding paragraph, our liability to passengers begins when they board and ends when they get off.

 

Article 8 In addition to the provisions of the preceding article, the Company shall be responsible for compensating for damages suffered by passengers in connection with the transportation.However, this does not apply when it is proved that our company and our staff did not fail to pay attention to transportation.

 

Article 9 If the Company temporarily suspends operations or takes other measures to ensure the safety of transportation due to natural disasters or other reasons not attributable to the Company, the Company shall compensate passengers for damages suffered as a result. I will not be held responsible.

 

(Passenger Responsibility)

Article 10 If the Company suffers damage due to a passenger's willful misconduct or negligence, or due to a passenger's failure to comply with laws and regulations or the provisions of this transportation agreement, the Company will demand the passenger to compensate for the damage.
